残疾儿童法律保护:一个中学生的视角与参与

为推进中国残疾儿童保护工作,联合国儿童基金会和中国残疾人联合会共同实施了“残疾儿童保护合作项目”。在北京召开的“中国残疾儿童法律保护研讨会”上,主题发言人撰写了“中国残疾儿童法律保护研讨会”的论文。为在会议宣讲并演示论文的内容,由我承担了视频资料的制作任务。

参与这项具有特别重要的意义的工作,是人大附中“中学生社会实践与社会服务活动”的组成部分。浮现在我脑海里是被地震撕裂的聚源中学和北川中学,因撕裂而致的揪心之痛是掩埋在废墟下那些青春与朝气如我一般的同学们。于是,在“地震致残儿童的基本权利保障”的视频背景上,我整个地选用了地震特有的蓝光,它的深沉与压抑让人几近窒息,但在地球的中央是以心形绽放的关爱与希望之花,进而在“生存权、平等权、教育权”上分别使用绿、红、蓝三种颜色,象征着希望、热烈与成长。在这三段文字的前面,还分别附有裂痕燥土上破茧而出的绿色幼苗、庄重的天平和毛主席手书的“学习”图案,昭示着党和政府对地震致残儿童的关怀和保障。

“生存权与医疗救助” 是地震致残儿童的基本权利保障之首。我选用新华社发布的抢救被掩埋多日获救的中学生的照片:在被救同学头上浸血的绷带、面部干硬的结疤的呼唤中,救护人员高举的输液瓶和医院病床上的小花说明了生命的脆弱、珍贵、顽强与医疗救助的紧迫和必要。绿色与红色的对应,红十字的标识进一步深化了“生存权与医疗救助”的主题。

在“生存权与康复治疗”,“篮球女孩”经过康复成功后背着书包站立的画面感人至深,一个盛开而多彩的花篮与她的笑脸交相辉映,共同灿烂,表达出我的美好祝愿。同时也强调:让地震致残儿童在治疗中康复,在康复后与我们共享一片蓝天。

“禁止歧视”以残疾人无障碍标识和简单的四个粗体字警醒人们:共享权益是包括地震致残儿童在内的每个人所应有的,残疾儿童与健全人平等生存与生活是和谐社会所应有的。

“共同参与” 中残疾人登山开车、植树造林,用他们的汗水浇灌着我们共同家园的绿茵。在图片的右上方,我专门加上了一轮金黄色的太阳,表达我们在共有的家园里共同沐浴温暖的阳光,共同创建美好的明天。

以七种颜色写出“灾区特殊教育学校”的文字,并辅之以残疾儿童学习手语的教学活动,充分表达了太阳的七色光芒照亮每一个残疾儿童心房的愿望。写在残疾儿童脸上的笑意和认真,也传达出他们对教育的渴望。这种渴望甚至比健全人更甚,令健全人惭愧,促健全人深思。

“灾区全纳式教育”强调的是家庭对残疾儿童成长的重要意义。家庭对孩子的成长至关重要,对于残疾儿童更有着不可取代的特殊意义。由此,我想到了灾区的孤儿,想到了那些失去亲人的灾区同龄伙伴们——“我想有个家”是他们需要之最。选用收养孩子的母亲和在收养母亲怀抱中的孩子,看着母亲眼中的承诺和幼儿泪水中的期盼,表达的是我最真诚的祝愿。

在视频的最后,我署上了我的名字,因为这里有双重责任:既是对制作作品的责任,更是自己对残疾人、对残疾儿童、对地震致残儿童的责任。为了保障和实现他们的基本权利,我愿做得更多。

 

在我的“中学生社会实践与社会服务”活动总结中,我写道:通过这次为“中国残疾儿童法律保护研讨会”论文发言人制作视频资料,我深刻体会出了为残疾儿童提供法律保护的使命感与自豪感。我了解到:因为可怕的地震而致使身体残疾的孩子,现在是如此地需要法律的屏障。他们也是孩子,同样是祖国的花朵。法律保障下的权利,是他们和我们同在一个社会、共有一片蓝天的护身符。

Legal Protection for Disabled Children: the Viewpoint and Participation of a Middle School Student

 

In order to promote the protection work for Chinese disabled children, the UN Children’s Fund and the China Disabled Persons’ Federation jointly carried out the Cooperative Project of Disabled Children Protection. In the Symposium on Legal Protection for Chinese Disabled Children held in Beijing, a treatise written for the Symposium by the main speaker was read and expounded, and I undertook the preparation of the video materials for presentation.

 

This particularly meaningful task is part of the activity of “Middle School Students Social Practice and Social Service” in the High School Affiliated to the Renmin University of China. Until now, the image still left in my memory is Juyuan Middle School and Beichuan Middle School destroyed by the earthquake, along which is the heartbreaking pang I felt for the students buried by the ruins who were as young as I. That is why I chose blue light exclusively, which is the signal of earthquake, as the background for the video materials in the symposium. Though the blue light looks depressive and suffocating, I designed a heart-shaped flower symbolizing love and hope in the middle of the earth and selected green, red and blue for the right to life, equality and education, symbolizing hope, warmth and growth. In front of the three passages are green sprouts growing from sterile land, a solemn scale and the word “Study” written by Chairman Mao Zedong respectively, implying the care and protection from the Party and the government for children disabled by the earthquake .

 

“Right to Life and Medical Aid” is the priority of the basic right protection of children disabled by earthquake. I chose a photo publicized by Xinhua News Agency showing the rescue of a middle school student been buried for several days. The blood-drenched bandage on the student’s forehead, the dried scab on his face, the dripping bottle held by a rescue worker and the flowers by the bed in the hospital have all illustrated how fragile, precious but tenacious life is and how urgent and indispensable medical rescue is. The theme “Right to Life and Medical Aid” was highlighted by the contrast between green and red and the sign of red cross.

 

Under the subject of “Right to Life and Rehabilitation Therapy”, the image of the rehabilitated “Basketball Girl” standing with a schoolbag is very impressive. Through the colorful flower basket and her beaming smile, we express our best wishes, and at the same time, our conviction: let children disabled by earthquake be healthy again and enjoy the same blue sky with us after rehabilitation.

 

Under the subject of “No Discrimination”, the barrier-free sign and four simple bold Chinese characters are used to remind people that to share rights and interests shall apply to every one of us, including disabled children, and that the equality between disabled persons and healthy persons is essential to a harmonious society.

 

Under the subject of “Joint Participation”, there are a group of photos showing disabled persons climb mountains, plant trees and irrigate green grass in our common homeland. On the upper right corner of the picture, I added specially a golden sun, which symbolizes that we are sharing the same warm sunshine and will create a better tomorrow together.

 

The name of the “Disaster Area Special School” written in seven colors, together with the picture of disabled children learning sign language, express a wish that the seven colors of the sun will light up the heart of every disabled child. The smile and earnest on each child’s face convey a longing for education, which are even stronger than that of healthy people, which set us into thinking.

 

The subject “Disaster Zone Comprehensive Education” highlights the significance of family in the growth of a disabled child. Family plays an irreplaceable role in the education of a disabled child. I thought of those orphans and young people of my age who had lost their relatives in the disaster zone, “a family” must be their most pressing need. I chose a photo in which a foster mother holds a young child with tears in her arm to express my most sincere wishes.

 

At the end of the video, I put my name, which conveys double responsibilities: one is the responsibility for the work and the other the responsibility for disabled persons, disabled children and those children disabled by earthquake. To protect their basic rights, I am willing to devote more.

 

 

In my summary of the “Middle School Students Social Practice and Social Service” activity, I wrote: through preparing video materials for the speaker of the Symposium on Legal Protection for Chinese Disabled Children, I have gained a deep understanding of the commitment and pride in legal protection of disabled children. I have come to realize that those children disabled by earthquake are in dire need of legal protection. As children as we are, they are also flowers of our motherland. Statutory rights are the safeguard for them to live with us in the same society and under the same blue sky.
